Public PSC: "The Trial" Workshop

Bournemouth University

Law Society Accredited One-Day PSC Elective Workshop

  1. Workshop Objectives

To practise and sharpen Advocacy skills and gain confidence.

These skills are developed during a mock Trial that has been carefully designed to facilitate valuable insights into the role of the advocate within the Trial process.

These insights enable Solicitors to reflect upon the context in which Advocates operate. For example, it encourages Solicitors:

    • To "see the wood for the Trees" and appreciate the importance of agreeing realistic case strategies with clients
    • To be aware of the risk factors associated with litigation
    • To emphasise that you "reap what you sow" and that careless pre-trial work such as drafting or correspondence can prejudice a party at the Trial or during negotiations
    • To gain insights into the function of statements of case and witness statements and their role at Trial
    • To fully recognise the function of the Judge during the Trial and the interaction between him/her and the Witnesses and advocates
    • To practise and gain competence in Examination and Cross-Examination skills
  2. Preparation and documentation

    • This session is based upon a case study that has been developed and improved over a six-year period. The case study includes full notes, pleadings, and witness statements, yet is designed to be factually uncomplicated.
    • Accordingly, delegates can concentrate on practising their advocacy skills and need spend no longer than approximately 1 1/2 hours in pre-workshop preparation. (Full instructions given)
  3. Workshop Structure and Training Method

    • Simulation and role play with demonstration and feedback
    • Tutor Demonstration and Coaching
    • Small Groups (ideal numbers between 6-10)
